当事務所では、破産事件も扱っております（破産の本も執筆した経験があります）。

仮に自己破産を申し立てるということになった場合は、まず、債権者たちに通知を送り、債務の弁済ができないことを伝えます。

そのようにして債務の弁済を止めた後、申立書類を作成していくことになります。申し立て書類を作成する際は、債権者の情報、財産の情報、破産に至る経緯などを確認していくことになります。破産の対象者が個人である場合は、浪費やギャンブルの有無なども確認していくことになります。

裁判所に対して申立てをすると、裁判所から書類審査を受けた後、破産手続が開始していくことになりますが、個人の場合は、破産管財人という別の弁護士を選任することなく、破産手続を終了（廃止）するという手続をとることもあります。ただし、それは例外的な取り扱いとされており、原則は、破産管財人が選任され、破産者の財産状況等を調査していくことになり、手続は最低でも３ヶ月はかかることになります。

I handle bankruptcy cases( I have published a book related to it.).

If you go bankrupt, first, I am going to send notifications to creditors, saying that my client can’t pay off their debts.

After you stop paying, I am set to prepare documents for filing. I will ask you the info on creditors, assets and how come you have to go bankrupt etc. If you are an individual, not a company, I need to ask you if you have wasted money or done some gambling.

If I file a bankruptcy to the court, it will have clerical check and then the procedure will begin. If you are an individual, the court sometimes skip assigning another lawyer as a bankruptcy trustee. That is, however, an exception, so, in principle, the court picks a bankruptcy trustee and the trustee do some research on bankrupt’s property etc. The procedure will take at least 3 months.
